Marital Infidelity

The continuing suspicion not supported by objective proof, often divides the couple instead of unifying it. On the other hand, if the concerns become real and tangible, they could transform into a not ideal and happy situation, but surely into a conscious awareness of a specific situation.

The acquisition of proof regarding marital infidelity could be useful in the separation lawsuit, and in dropping the claims for maintenance allowance.
The charging verdict implicates financial consequences towards the partner to whom the separation was accused. The latter, in fact, loses the right to the maintenance allowance, keeping only the alimony check, if the prerequisites are kept.

The separation was charged to the husband who showed an arrogant behavior towards his spouse. In addition, the husband, while his wife was ill, had an extra-marital relationship with the maid, and left their home without a reason.

The Court believes that also one episode of physical violence is enough to declare the separation charge.

The charge of separation is to blame at the husband who made public an extra-marital relationship, causing a great damage to the image and dignity of his wife.

The separation is rightful, with additional charge of responsibilities to the husband who had an extra-marital relationship with another man (homosexual relationship).
